TRADE BOOKING TERMS AND CONDITIONS

Effective for bookings from 24 January 2022

 

1.    OVERVIEW

1.1    These Terms and Conditions apply to FIT bookings, and Ad Hoc Group bookings of no more than 3 departures and no more than 30 rooms, made directly with Voyages for Voyages Products, where: (a) you are a third-party travel agent or tour operator and (b) you are not a party to a separate booking contract with Voyages.

1.2    These Terms and Conditions are effective as at the date specified above and may be amended or supplemented by Voyages at its discretion from time to time. The Terms and Conditions applicable to your booking are those that are current at the time a booking is made.

1.3    Promotional deals, packages and special events offered or arranged by Voyages may be subject to special terms and conditions (Special Conditions). These Special Conditions will be made available to you at the time you make your booking. To the extent of any inconsistency between Special Conditions and these Terms and Conditions, the Special Conditions will prevail to the extent of the inconsistency in relation to the specific deal, package or event.

1.4    Voyages operates Ayers Rock Resort together with the Sounds of Silence, Field of Light, Tali Wiru, Desert Awakenings, Gallery of Central Australia (GoCA) private art tours and Outback Sky Journeys.

1.5    All prices quoted are in Australian Dollars. Voyages accepts no responsibility for any differences in currency exchange rates or refunds relating to currency exchange fluctuations.

1.6    “Us, we, our, Voyages” all mean Voyages Indigenous Tourism Australia Pty Ltd (ACN 146 782 591). “You, your” means the third-party travel agent or tour operator who is making a booking.

2.    GENERAL

2.1    You warrant to us that: (a) you have the power and authority to make the booking and enter into a binding contract with us; (b) the information you provide to us about the person or persons included in the booking (‘Guest’) is true, accurate, current and complete as required by any registration process; and (c) you will maintain and promptly update this information to keep it true, accurate and complete.

2.2    To the extent applicable, you are deemed to have accepted these Terms and Conditions on behalf of the Guest(s). It is your responsibility to ensure persons on whose behalf you are making the booking understand any Terms and Conditions which are relevant to their booking.

2.3    You must provide Voyages with the contact details for the Guest(s) named in the booking. Voyages reserves the right to cancel the booking at any time if such contact details are not accurately provided at the time the booking is made.

2.4    To the extent permitted by law, all conditions, warranties, guarantees, rights, remedies, liabilities and other terms implied or conferred by statute, custom or the general law that impose any liability or obligation on Voyages are excluded under these Terms and Conditions. Nothing contained in these Terms and Conditions excludes, restricts or modifies the application of any provision, the exercise of any right or remedy, or the imposition of any liability which cannot be excluded under the Australian Consumer Law.

2.5    Any maps and photographs of the destination are indicative only. Actual rooms occupied may vary in décor and inclusions from those shown in any photographs.

2.6    These Terms and Conditions are governed by the laws of New South Wales, Australia.

2.7    These Terms and Conditions represent the entire agreement between the parties in relation to its subject matter and supersedes and replaces all previous agreements, understandings, representations and warranties about that subject matter.

2.8    Voyages is committed to protecting your personal information. Please refer to Voyages’ Privacy Policy which is available at https://www.ayersrockresort.com.au/terms-and-conditions/privacy-policy.

2.9    In these Terms and Conditions:

(a)    ‘Ad Hoc Group’ means a group of guests who are travelling together and are to be accommodated in 10 rooms or more at any property at Ayers Rock Resort or travelling with a tour leader or as otherwise determined by Voyages;

(b)    ‘FIT’ means fully independent traveller being a guest who is travelling alone or who is otherwise classed as a full independent traveller by Voyages;

(c)    ‘Voyages Guest Conduct Policy’ means the guest conduct policy relating to guest conduct while at Ayers Rock Resort, as may be published by Voyages on its websites or notified to you or the Guest from time to time.

(d)    ‘Voyages Policies’ means Voyages’ Privacy Policy, Voyages’ Guest Conduct Policy, any policy specified in these Terms and Conditions and any other policy that may apply to a booking made by you, as may be published by Voyages on its websites or notified to you from time to time.

(e)    ‘Voyages Products’ means the accommodation and tour products offered by Voyages at Ayers Rock Resort.

3.    BOOKINGS

3.1    Booking requests must be made through Voyages’ nominated online booking platform or direct online channel connection or sent by email to [email protected] (for FIT bookings) or [email protected] (for group bookings).

3.2    booking request for a Voyages Product must be in writing and must specify the following information (‘Booking Request’):

(a)    the full names, emails and/or mobile number of the Guests for FIT bookings; Team Leader name and contact details for group bookings;

(b)    the date, means and expected time of arrival;

(c)    the date, means and expected time of departure;

(d)    the Property at which accommodation or meals are required;

(e)    the number of rooms required;

(f)    the type of rooms required;

(g)    the Voyages Tours and transfers required;

(h)    Voyages’ Rate Code (if known); and

(i)    any special requirements, e.g. dietary needs, disabled access needs, etc.

3.3     You acknowledge and agree that Voyages requires the contact information (such as a mobile phone number and/or email address) of the primary Guest for all bookings for the purposes of communicating operational matters concerning Ayers Rock Resort or Ayers Rock Airport with guests in the 24 hours prior to arrival and during their time at Ayers Rock Resort. The Guest’s contact information will not be used by Voyages for marketing purposes. Voyages reserves the right not to confirm a booking by issuing a booking confirmation number if the primary Guest’s email and/or mobile phone number has not been provided to Voyages at the time of the Booking Request.

3.4    Upon receipt of a Booking Request made in accordance with clauses 3.1, 3.2 and 3.3, Voyages will, subject to availability as determined by Voyages in its absolute discretion, issue you with a booking confirmation number in respect of that Booking Request. Booking Requests made via Voyages’ nominated online booking platform or direct online channel connection will receive an instant booking confirmation number. Booking Requests made via email will receive a Booking Confirmation Number within 5 business days or advised of alternative options if available. Upon receipt of a Booking Confirmation Number, the Booking Request will become a confirmed booking (‘Confirmed Booking’).

4.    RATES AND PAYMENTS – FITs

4.1    All quoted rates on our website, advertisements or brochures are subject to change at any time until the booking is confirmed. Some rates which are quoted are only valid for a minimum number of nights and if the number of nights included in your booking changes the rate may also change.

4.2    The quoted rates are nett rates and are non-commissionable. All tour rates are per person nett rates and exclude any National Park entry fees and other government charges that may apply to the tour.

4.3    Full payment is required at the time of booking for bookings made 30 days or less prior to the arrival date for FIT bookings. Payment terms may vary for special rates or for bookings made via the Voyages trade booking platform and you will be advised of such payment terms at the time of booking.

4.4    Payments can be made by credit card or bank deposit. Payments made by credit card will incur a merchant service fee in addition to the total amount payable. All relevant merchant fees will be disclosed at time of booking and on the invoice.

4.5    Where you fail to make a payment for a Confirmed Booking (by the due date stated on the invoice, Voyages may in its absolute discretion cancel the Confirmed Booking and charge the Client the cancellation fee specified in clause 5 or as otherwise specified by us for that Confirmed Booking.

5.    RATES AND PAYMENTS – GROUPS

5.1    Rates will be quoted by our reservations team at time of booking request in writing.

5.2     The quoted rates are nett rates and are non-commissionable. All tour rates are per person nett rates and exclude any National Park entry fees and other government charges that may apply to the tour.

5.3    A security deposit of 25% of the contracted rate per room per night and 25% of the total value of touring is due within 14 days of receipt of confirmation. A Confirmed Booking may be cancelled by Voyages if the security deposit is not received within 14 days. The balance of all confirmed accommodation, pre-booked meals, transfers and day tours is due 45 days prior to group arrival. Bookings within 45 days of arrival require full payment at the time of booking.

5.4    For groups of 31 rooms or more special terms and conditions will apply and will be advised at the time of enquiry.

6.    ACCOMMODATION AND TOUR CANCELLATION POLICY - FITs

6.1    If you cancel your booking and your cancellation notice is received by us:

(a)    more than 7 days prior to your scheduled check-in date, we will not charge you a cancellation fee; and

(b)    7 days or less prior to your scheduled check-in date, a cancellation fee equal to 100% of your total booking value (all prepaid accommodation, meals and tours) will apply.

6.2    If the booking was made via the Voyages online booking platform, the booking must be cancelled via the link provided on the confirmation email. You will receive an email confirming the cancellation. All cancellation notices must be provided to us in writing by email to [email protected] and will only become effective when received by us.

6.3    If your client does not present for your booking, or if you cancel your booking after you have checked in or arrived, a cancellation fee equal to 100% of your total booking value will apply.

7.    ACCOMMODATION AND TOUR CANCELLATION POLICY - GROUPS

7.1    Group bookings cancellations must be made in writing and provided to the Voyages Travel Centre.

7.2    Cancellation fees for group bookings are as outlined in schedule below:

7.3    Special cancellation terms and conditions will apply to Voyages’ exclusive use touring and accommodation and will be advised at time of request.


8.    ALTERNATIVE ACCOMMODATION

8.1    In the unlikely event that Voyages cannot provide the specific accommodation described in the Confirmed Booking, you acknowledge and agree that the Guest(s) may be relocated into an alternative accommodation at Ayers Rock Resort at the applicable rate specified for the accommodation booked by you, or the best available nett rate for the alternative accommodation, whichever is the lower.

8.2    If the alternative accommodation is not of a similar standard to the accommodation booked, then Voyages may in its discretion offer appropriate compensation (which may be non-monetary) to the relocated guest.

8.3    Neither you nor the relocated Guest shall have any other claim or recourse against Voyages arising from the relocation.

9.    TOUR BOOKINGS

9.1    Voyages makes every effort to operate tours as advertised. However, itineraries may need to be changed at short notice due to weather, accessibility or other events outside of Voyages’ control. If changes are necessary, we will make reasonable efforts to supply the Guest with a tour that is equivalent to the advertised itinerary in all material aspects. Voyages will make reasonable efforts to inform the Guest of any changes in advance via the contact details provided at the time of booking.

9.2    If Voyages is unable to provide a tour that is equivalent to the advertised itinerary, Voyages will offer your or the Guest (as appropriate) the choice of:

(a)    rebooking the tour for another day; or

(b)    receiving a refund for the tour less any reasonable expenses incurred by us or services consumed by you (if any).

9.3    Due to their nature, participation in tours may require a minimum level of fitness or physical capability. Any specific requirements will be notified to you at the time of booking and you undertake to inform the Guest(s) of such requirements. By booking a tour, your warrant and represent that the Guest(s) satisfies any minimum requirements notified to you. If Voyages (acting through its authorised tour leader) reasonably decides that the Guest(s) does not meet the minimum physical requirements, Voyages may remove the Guest(s) from any tour or transfer at any time without providing a refund.

9.4    Certain tours are suitable for children provided they are accompanied by a parent or guardian during the entire tour. Child rates apply to persons 15 years old and under at the time of the tour. Some tours cannot accommodate children, as specified below:

(a)    Desert Awakenings and Outback Sky Journeys – children aged 5 years and under are not permitted;

(b)    Tali Wiru – persons aged 15 years and under are not permitted; and

(c)    Sounds of Silence - children aged 9 years and under are not permitted.

9.5    Parents and guardians are responsible for ensuring that children under their supervision do not reduce or impact on the enjoyment of other persons on the tour. Non-compliance with this requirement may result in the child and their parent or guardian, being directed to leave the tour or transfer without providing a refund.

10.    GUEST CHECK-IN REQUIREMENTS

You undertake to advise the Guest of the following check-in requirements:

10.1    Photographic identification: Each Guest will be asked to provide government issued photographic identification upon check-in at the accommodation. If the Guest is unable to provide such identification, the booking may be cancelled, and you will be liable to pay Voyages an amount equal to the full booking amount plus other costs incurred by Voyages in connection with the booking.

10.2    Credit card authorisation: FIT Guests will need to provide a credit card authorisation upon check-in. This authorisation may be used to cover incidental items including but not limited to telephone charges, security bond or deposit for any breakages or damage incurred during the Guest’s stay or cleaning charges in excess of the normal level of cleaning.

10.3    Cash deposit: If a credit card is not available, a minimum AU$120 cash deposit per day (or such other amount reasonably nominated by us at the time of check-in) will be required on check-in for FIT guests. Once the full cash deposit has been utilised during the Guest’s stay, then a further cash deposit will need to be provided by the Guest to cover any further charges.

10.4    Check-in requirements for groups may differ to FITs and you will be advised of those requirements prior to arrival.

11.    FORCE MAJEURE

11.1 Voyages is not responsible for any liability or loss arising out of any occurrences or conditions beyond Voyages control, including but not limited to acts of terrorism, acts of God, war, strikes, theft, delay, weather conditions, epidemic, pandemic or any other type of public health emergency, civil disorder, disaster or changes in Government regulations, directives or declarations (‘Force Majeure Event’).

11.2    If Voyages is prevented, delayed or hindered from fully or partly fulfilling a booking or a booking is affected, directly or indirectly, by a Force Majeure Event, then Voyages may:

(a)    cancel or postpone the whole or part of the booking affected by the Force Majeure Event; and

(b)    take any other action which is necessary or desirable (acting reasonably) in connection with the Force Majeure Event.

12. PRIVACY 

12.1    You warrant that you comply with all applicable privacy laws including the Privacy Act 1988 (Cth) in relation to any personal information of persons residing in Australia and the European Union’s General Data Protection Regulation (GDPR) in relation to any personal data of persons residing in the European Union.

12.2    You agree to advise each Guest, when collecting personal information from a Guest, that such information may be passed on to Voyages for the purpose of providing the Voyages Products, and that Voyages’ use of such information is governed by its privacy policy, which is available on its websites (being, www.voyages.com.au and www.ayersrockresort.com.au).

13. CHILD POLICY

13.1    ‘Child’ or ‘Children’ means a person or persons aged between 2 years and 15 years at the time of check-in.

13.2    Children at Ayers Rock Resort:

(a)    Accommodation: Children stay for free when using existing bedding. Extra person charges apply for additional rollaway beds.

(b)    Buffet Breakfast:

    (i)    One Child aged up to 12 years old who is accompanied by one paying adult may dine free of charge for breakfast at restaurants serving buffet breakfast. Additional Children aged up to 12 years old accompanying the same adult may dine at a reduced price for breakfast. Applies to buffet breakfast only.

    (ii)    Children aged between 13 years and 15 years may dine at a reduced price for breakfast at restaurants serving buffet breakfast. Applies to buffet breakfast only.

(c)    Lunch and Dinner: Specially priced Children’s menus are available at selected restaurants for lunch and dinner.

(d)    All Children must be accompanied by an adult at all restaurants.

(e)    Use of swimming pools: Minors or infants may only use the hotel swimming pools if they are toilet trained and under their parent’s or guardian’s supervision at all times. No minor or infant is permitted to enter the hotel swimming pools wearing nappies including swimming nappies.

14. VOYAGES POLICIES

14.1    You will ensure that each Guest is made aware of the Voyages Policies at the time of booking.

14.2    You will ensure that each guest agrees to comply with Voyages Guest Conduct Policy and any other Voyages Policies applicable to the booking.

14.3    All Guests are required to comply with all applicable government directives, orders or regulations including any health and safety procedures or policies that are in place at Ayers Rock Resort. Failure to comply may result in refusal of entry or removal from the Resort.

15. OTHER GROUP CONDITIONS

15.1    Group Porterage Policy: Porterage charges (as stated below) apply to all group bookings regardless of property or room type booked (excluding dorm rooms).

(a)    2022/23: AU$7.00 per adult, round trip for groups.

(b)    2023/24: AU$8.00 per adult, round trip for groups.

15.2    Room List Requirements: Final rooming list, meal and tour requirements are due 30 days prior to arrival.

15.3    Group Bookings Complimentary (FOC) Policy:

(a)    One FOC room and group pre-booked meals (excluding Voyages Touring) is provided for a bona-fide tour escort/group leader per every 10 paying rooms to a maximum of 2 FOC rooms for two bona-fide tour escort/group leaders (i.e. the 11th & 22nd rooms are FOC).

(b)    FOC accommodation is Run of House across Ayers Rock Resort and is subject to change at Voyages' discretion. If available, rooms will be allocated within the hotel where the group is staying. Otherwise, next best available accommodation will be allocated. Lodge rooms may be allocated if all hotel rooms are fully booked.

(c)    FOC rooms will automatically be applied to eligible group bookings unless otherwise advised in writing at time of booking.

15.4    Conference and Incentive Groups & Exclusive Touring:

(a)    When a group requires meeting room facilities or special event or dining requirements, it may be considered a Conference and Incentive Group and separate Voyages business events contract terms and conditions will apply. All Conference and Incentive Group requests should be made to the Voyages Conference & Incentive Sales Department.

(b)    Special terms and conditions apply to Voyages exclusive use touring. These terms and conditions will be advised at time of enquiry.

16. CANCELLATION OR POSTPONEMENT BY VOYAGES

16.1    Voyages reserves the right to cancel or postpone the whole or any part of a booking if any of the following events(or a combination of them) occur including (without limitation):

(a)    sovereign acts of any federal, state, territory or foreign governments including war (undeclared or declared);

(b)    any federal, state, territory or foreign government action, restriction, restraint or intervention, or local or state of emergency of any kind;

(c)    any order, direction or request of any authority (whether local, state, territory or federal); (d) epidemic, pandemic or any other type of public health emergency;

(e)    civil commotions, demonstrations, insurrections, riots, explosions, vandalism, sabotage or acts of terrorism or any other act against public order or authority;

(f)    natural disasters or extreme weather conditions, or other adverse weather conditions resulting in fires, flooding, power outages, road closure or damage to property;

(g)    labour or industrial disputes, action, embargo or strike, or any disruption to the provision of goods and services to Ayers Rock Airport or Ayers Rock Resort;

(h)    any event, circumstance or emergency affecting the operation of Ayers Rock Airport, Ayers Rock Resort or any accommodation (or any part of them) including any quarantine measures or disruption to the supply of goods and services to Ayers Rock Airport or the Resort; or

(i)    any other event, circumstance or cause beyond the control of Voyages (other than adverse economic conditions or general financial constraints).

16.2    In the event that Voyages cancels or postpones the whole or any part of a booking affected (directly or indirectly) by any of the events in clause 16.1, Voyages will give notice of the cancellation or postponement and the terms of the cancellation or postponement as may be reasonably determined by Voyages at the relevant time. Voyages will not be liable to any person for any claim, liability, loss, cost or expense arising from (directly or indirectly) such cancellation or postponement.
